Terms of Service

The short version: CommentatorOS gives you fact-checked match preparation, you stay in charge of what you say on air, payments run through Stripe, you can cancel any time and keep access to the end of the period, and we treat your data with care. The detail follows.

1. Who we are

CommentatorOS is operated by Mark Makin, an independent professional (autonomo) registered in Spain ("we", "us"). You can contact us at info@markmakin.com.

These terms are a binding agreement between you and us. By creating an account or using CommentatorOS you accept them. If you do not accept them, do not use the service.

2. What CommentatorOS is

CommentatorOS produces match preparation documents for sports commentators and broadcast professionals. Documents combine data, statistics and editorial context, and clearly label the confidence of each item: facts verified against two independent sources, items flagged for your own check, and clearly marked analysis or opinion.

CommentatorOS is a preparation aid. It does not replace your own editorial judgement, and you remain solely responsible for what you say on air or publish.

3. Accounts

You need an account to use the portal. Sign-in is by secure email link; you are responsible for keeping access to your email account secure and for all activity under your account.

One account is for one named person. Sharing a login, reselling access or providing documents to third parties as a service is not permitted without our written agreement.

You must be at least 18 to use the service.

4. Plans, credits and billing

Paid plans are Solo (8 match documents per month) and Pro (24 match documents per month), plus a single one-off document purchase. Current prices are shown on the site at all times.

  • One credit unlocks one match document. A prepped document stays in your history and can be reopened at no further cost, including its live updates through kickoff.
  • Credits reset at the start of each billing period. Unused credits do not roll over.
  • Annual plans are paid up front for 12 months at the equivalent of 10 monthly payments.
  • If you run out of credits you can upgrade your plan or buy a single document.

Payments are processed by Stripe. Purchases are made through Stripe as merchant of record, which means Stripe is the seller of the subscription for payment and tax purposes, handles applicable VAT or sales tax, and appears alongside CommentatorOS on your statement. We never see or store your card details.

5. Cancelling and refunds

You can cancel at any time from your subscription page. Cancellation takes effect at the end of the current billing period: you keep full access until then and are not charged again.

Except where the law requires otherwise, fees already paid are not refunded for partial periods. Statutory rights that cannot be excluded, including any mandatory withdrawal rights under EU or UK consumer law, are unaffected.

We may change prices with at least 30 days notice. Changes apply from your next billing period; if you do not accept a change, cancel before it takes effect.

6. Accuracy and editorial responsibility

We work hard on accuracy: factual claims are cross-checked against two independent sources before they are presented as verified, and anything we could not verify is flagged for your own check.

Sport moves fast. Team news changes, statistics are corrected at source, and predicted lineups are predictions. We therefore cannot guarantee that every item in a document is accurate, complete or current, and documents are provided for your preparation only.

You are responsible for your own broadcast output. We accept no liability for statements you make in reliance on a document.

7. Intellectual property

The service, its software, design and generated documents are our intellectual property or that of our licensors. We grant you a personal, non-transferable licence to use documents for your own professional preparation, including printing and exporting PDFs for your own use.

Your own notes remain yours. You grant us the limited licence needed to store and display them to you as part of the service.

CommentatorOS is independent. It is not affiliated with, endorsed by or connected to any league, competition, club or broadcaster named in documents.

8. Acceptable use

  • No scraping, bulk extraction or systematic redistribution of documents or data.
  • No attempting to probe, breach or test the security of the service.
  • No use of the service to build a competing product.
  • No unlawful use, and no uploading of content you have no right to use.

We may suspend or close accounts that breach these terms. Where practical we will warn you first.

9. Service availability and changes

We aim for the service to be available at all times but do not guarantee uninterrupted availability. We may improve, change or withdraw features. If we withdraw the service entirely we will give reasonable notice and refund any prepaid period beyond the closure date.

10. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.

Subject to that, we are not liable for indirect or consequential losses, loss of profit, loss of opportunity or reputational loss, and our total liability arising out of or in connection with the service is limited to the fees you paid us in the 12 months before the event giving rise to the claim.

11. General

We may update these terms. For material changes we will notify you by email or in the app at least 14 days before they take effect; continued use after that date is acceptance.

These terms are governed by Spanish law. If you are a consumer you also benefit from any mandatory protections of the law of the country you live in, and you may bring proceedings in your local courts.

If any part of these terms is found unenforceable, the rest remains in force.
